Personal tax credit for investment in an alternative investment fund
Taxpayers who invest in an alternative investment fund in the current calendar year are given a personal tax credit for that year.
According to the Personal Income Tax Law (Article 89a), a taxpayer who invests in an alternative investment fund for the purpose of acquiring investment units is entitled to a personal tax credit of up to 50% of the investment made in the calendar year for which the tax is determined. The calculated tax credit cannot exceed 50% of the determined tax liability.
To maximize tax benefits, taxpayers must invest in the current calendar year for the current year liability that will be determined in the following year. In other words, the minimum amount the client needs to invest in the fund should correspond to their tax liability.
The right to a tax credit can only be exercised on the basis of fully paid cash contributions acquiring investment units of an alternative investment fund.
If the taxpayer sells or transfers shares, units, or fund units in the calendar year in which the investment was made, or within the following three calendar years, they lose the previously granted tax credit for that investment.
The taxpayer is required to notify the competent tax authority within 30 days of losing the right to the tax credit and pay the obligation corresponding to the previously recognized tax credit, along with the applicable interest calculated from the due date of the annual personal income tax for the year in which the right to the tax credit was lost.
An example of a tax benefit based on an investment in an alternative investment fund:
A client with an annual personal income tax obligation of EUR 10,000, upon investing in an alternative investment fund in the amount of their tax obligation, educes the obligation up to 50%. In our example by EUR 5,000.
Taxation of ownership and transfer of ownership of fund investment units, i.e. capital gains, as the difference between the acquisition price and redemption price of investment units, is defined by the following tax regulations of the Republic of Serbia:
In order to determine and pay capital gains tax, the fund member is obliged to, after purchasing the investment units, file a tax return to the tax authority in their territory of residence (head office for businesses).
